Abstract

National criminal law has always been influenced by other legal systems, foreign scholars, philosophers etc. Nowadays such adaptations and developments are not only taking place by free choice. More and more changes are forced upon the national systems from supranational and international bodies and courts. This means that the national legal system loses its coherency and legitimacy, and thus that our society becomes less of a Rechtsstaat. The often heard argument of necessity with regard to fighting international and cross-border crime is not convincing. The article argues for a turning back of the wheels.
