Resumé

Facial recognition technology has the potential to enhance police investigations, but risks significant intrusions into fundamental rights, such as the right to privacy. Drawing on the European Convention on Human Rights (ECHR), the AI Act, and the EU Law Enforcement Directive, this article examines the two uses of facial recognition granted to Danish police in 2024: victim recognition in cases of child sexual abuse and facial recognition of suspects in serious violent crimes. At present, the use of facial recognition by Danish police is guided solely by political decisions, resulting in highly ambiguous frameworks regarding the types of cases in which the technology may be used and the databases that may be cross-referenced. The article argues for clear legal authorization in compliance with the Law Enforcement Directive.
